1. Risk and Title
The products will be at your risk from the time of delivery. You, and not Brindle Pet Supplies, are solely responsible for the proper preparation and storage of any products you receive through our Services. Any use of our products is at your own risk. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges as may be applicable.
A subscription will run until you decide to cancel. This means your subscription will not have any date of expiration. Cancelation needs to be done at least 48 hours before your next scheduled delivery date.
3. Delivery Restrictions and Conditions
For local deliveries in Red Deer, Alberta, delivery will be made next business day when possible. Visit our Shipping and Deliveries page for estimated shipping times and costs to all other areas. If an item is out we will contact you to cancel the order or advise when we will be able to deliver your order. Backordered items can take anywhere from 5 – 10 business days to ship. If the backordered item becomes unavailable, your order will be canceled and you will be notified by email. Local deliveries will be made by our in-house delivery drivers and contracted to outside delivery services as required. Shipments outside of Red Deer will be shipped via Canada Post. To receive the delivery, you must live in a residential apartment or home, or receive permission from an employer or business owner to receive shipments from a business address. Delivery is not available on weekends or holidays. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive the delivery. Users can change subscription delivery frequency as many times as they would like, however you must make the changes 48 hours before your scheduled delivery. After this time the system will not allow you to make any changes. In the case of inclement weather, holidays or unforeseen delivery complications, it may be necessary to adjust our delivery schedule. If there will be a significant delay, a customer service representative may call or e-mail you to let you know the status of your delivery time. Your order will be delivered as quickly as possible when the conditions permit. If your designated delivery location (i.e., street, avenue) or day is inaccessible, rendering us or our carriers unable to make the delivery, you are responsible for picking up your package at an alternate location (ie. post office). 4. Product Quality and Availability
At Brindle Pet Supplies, we believe in providing your pet with the best quality products, however, it is the customers’ responsibility to complete all due diligence on any product they purchase from Brindle Pet Supplies before use. Brindle Pet Supplies does not guarantee the ingredients or nutritional analysis of any products it may supply to any subscriber. Brindle Pet Supplies makes every effort to ensure you receive your product in the best condition possible, however, we cannot guarantee the condition of any product after delivery, including but not limited to Frozen or Perishable products. Brindle Pet Supplies is not responsible for any “recalled” product delivered to the subscriber nor can it be responsible for any ingredient intolerances or allergies that may arise from any products provided to the subscriber by Brindle Pet Supplies. Brindle Pet Supplies makes every effort to ensure that any product(s) you have subscribed to is available for delivery. However, market shortages can occur, and Brindle Pet Supplies will provide one replacement product of equal or greater value in exchange for the product not currently available. Brindle Pet Supplies will provide this replacement product at no additional cost to the subscriber. If the shortage continues past the first missed delivery, we will contact you to find a new acceptable product to exchange your subscription with.
5. Price and Payment
All prices, including but not limited to product and delivery pricing, are quoted in Canadian Dollars unless otherwise specified. Credit Cards are processed on the day of renewal for all subscription purchases. This includes all delivery fees, recurring delivered products as well as any one-time delivered products. Prices on products may increase over time due to increases required by the manufacturers. Your subscription total will reflect any changes to product prices. New or increased pricing will be reflected on your subscription renewal reminder that is sent via email 48 hours before your subscription renews. Be sure to check prices on your subscription renewal reminder to be conscious of any price changes. If you place an auto-renew order with a one-time discount code, the discount code will be removed at the time of your first renewal. One-time discount codes will only be applied to your first delivery. If you place an auto-renew order for an item that is on sale, the sale price will be removed from future deliveries once the sale ends. You may change your payment method at any time by updating your account information. If payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your payment method information or cancel your account, you remain responsible for any uncollected amounts and authorize us to charge your selected payment method, as it may be updated. If you continue with your subscription for 1 delivery without completing payment to Brindle Pet Supplies your account will be suspended, and your information will be forwarded to collections. You are fully responsible for all activities that occur under your account, and you agree to be personally liable for all charges incurred under your account. Your liability for such charges shall continue after termination of this Agreement. Skipping Deliveries and/or order cancellation requests require advance notice to Brindle Pets via email communication. Any changes to your delivery/order need to be made at least 48 hours before your scheduled delivery. If you miss these deadlines, you will be responsible for paying the applicable amount, and the cancellation will take effect on the next delivery.
All promotions and coupon codes are eligible for a one-time use per user and/or shipping address unless specified otherwise. Brindle Pet Supplies has the right to cancel orders if abuse of discount/promotion/coupon codes occurs.
Referral Credits will only be applied if a successful referral of a NEW client is performed. New clients must have a unique shipping address and cannot live within the same household and/or use the same shipping address as the existing client (referer). A successful referral of a new client means a new customer has used the existing customers unique referral code to place a Brindle Pet Supplies order. Brindle Pet Supplies has the right to cancel orders if abuse of referral program occurs. Abuse of the referral program includes but is not limited to creating secondary accounts to use your own unique code.

7. Proprietary Rights
This Website and the information and materials that it contains are the property of Brindle Pet Supplies and its licensors and are protected from unauthorized copying and dissemination by copyright law, trademark law, international conventions, and other intellectual property laws. All product names and logos are trademarks or registered trademarks of Brindle Pet Supplies, Brindle Pet Supplies’ advertising partners, contractors, manufacturers or wholesale distributors. Nothing contained on this Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use this website or any materials displayed on this Website, through the use of framing or otherwise, except (a) as expressly permitted by these Terms; or (b) with the prior written permission of Brindle Pet Supplies, Brindle Pet Supplies’ advertising partners, contractors, manufacturers or wholesale distributors.
8. Your Passwords and Account Security
You are responsible for safeguarding the password that you use to access your account and you are responsible for any activities or actions under your password. You agree to keep your password secure. Brindle Pet Supplies will not be liable for any loss or damage arising from your failure to comply with these requirements. 9. Disclaimer of Warranties
To the extent permitted by law, the services are provided ‘as is’ and Brindle pet supplies disclaims all representations, warranties and conditions, either express, implied, statutory, by usage of trade, course of dealing or otherwise including but not limited to any implied warranties of merchantability, non-infringement, title, satisfactory quality or fitness for a particular purpose. Brindle pet supplies does not warrant, endorse, guarantee, provide any conditions or representations, or assume any responsibility for any product or service advertised or offered by any third party through the website or with respect to any website that can be reached from a link on the website or featured in any banner or other advertising on the website, and Brindle Pet Supplies shall not be a party to any transaction that you may enter into with any such third party.
10. Limitation of Liability
Under no circumstances shall Brindle pet supplies be liable for any direct, indirect, incidental, special, consequential, exemplary or other damages whatsoever, including, without limitation, any damages that result from (i) your use of or your inability to use the services, (ii) the cost of procurement of substitute goods or services, (iii) errors, mistakes, or inaccuracies in the materials on the website, (iv) personal injury (including without limitation any allergic reactions to any products received through the services) or property damage of any kind whatsoever arising from or relating to your use of the service, any bugs, viruses, trojan horses, or any other files or data that may be harmful to computer or communication equipment or data that may have been transmitted to or through the website, or (v) any errors or omissions in any material on the website or any other loss or damage of any kind arising from or relating to your use of the services. These limitations shall apply even if Brindle Pet Supplies has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Brindle pet suppliers’ liability to you for any damages arising from or related to this agreement (for any cause whatsoever and regardless of the form of the action), will at all times be limited to the greater of (a) fifty Canadian dollars ($50) or (b) amounts you’ve paid to Brindle Pet Supplies in the prior 12 months (if any). The foregoing limitations shall apply to the fullest extension permitted by law in the applicable jurisdiction. You agree that it is your sole responsibility to ensure that any products you obtain through the services are suitable for you and to ensure that you do not order any products that you may be allergic to.
You shall indemnify and hold Brindle Pet Supplies and its subsidiaries, affiliates, officers, agents, and employees, harmless from all claims, threats, actions, proceedings, demands, damages, losses, obligations, costs, and expenses including reasonable attorneys’ fees, made by any third party due to or arising in connection with your use of the services, any violation by you of these terms, or any violation by you of any applicable law or regulation.
